General Terms of Service

These Terms of Service (“Terms”) govern your use of this website, and any purchases made from www.florenciamartinart.com (“we”, “us”, “our”). By accessing this website or purchasing from it, you agree to be bound by these Terms

1. Commission Process

Commissions are created in close collaboration with the client. The general process includes:

1.1 Initial Enquiry
Submit an enquiry via email or the commission form outlining your idea, preferred medium, dimensions, timeline.

1.2 Quote and Confirmation
We will respond with a quote, proposed timeline, and scope of work. Once approved, a 50% non-refundable deposit is required to secure the commission.

1.3 Development & Updates
You’ll receive 1–2 progress updates at key stages (e.g. sketch or composition). Minor revisions are included; major changes may incur additional costs.

1.4 Completion and Final Payment
Once the artwork is complete, we will send final images for approval. The remaining 50% is due prior to shipping or delivery.

2. Deposits and Payments

  • Deposit: 50% non-refundable deposit is required before work commences

  • Final Payment: Balance due upon completion, before shipping or handover

  • Payment Methods: Accepted via credit card, PayPal, or direct bank transfer

  • Payment Schedule Extensions: May be available upon request for larger commissions

3. Timeframes

Completion timelines vary depending on the scale and complexity of the work. Estimated delivery dates will be discussed and confirmed at the start of the project.

  • Standard turnaround: [Insert estimate, e.g. 4–6 weeks]

  • Rush Commissions: May be available and subject to a surcharge

4. Revisions

  • The quote includes [one/two] round(s) of minor revisions during the production phase

  • Additional changes or major alterations outside the original brief may incur extra fees

  • Once approved and completed, no further changes can be made

5. Copyright and Usage

All commissioned artworks remain the intellectual property of the artist. The client receives the physical artwork and a personal-use license only.

You may not:

  • Reproduce, distribute, modify, or use the artwork for commercial purposes without written permission

  • Create merchandise, promotional materials, or derivative works

  • Claim authorship of the artwork

You may:

  • Display the work in your home, office, or non-commercial space

  • Share images of the artwork online with credit to the artist

Commercial licensing may be available for an additional fee and must be arranged in advance.

6. Moral Rights

The artist retains all moral rights. You agree not to crop, alter, misrepresent, or display the artwork in a way that damages the artist’s reputation. Proper credit must be given when the artwork is displayed publicly or shared online.

7. Cancellation and Refunds

  • If you cancel before work has begun, your deposit will be retained, but no further payment is required

  • If you cancel after work has commenced, the deposit will be retained and partial payment may be requested for work completed

  • If the artist cancels the commission for any reason, you will receive a full refund including your deposit

8. Shipping and Delivery

All shipping, packaging, and insurance costs will be outlined in your quote.

  • Domestic shipping via Australia Post, Sendle, or courier

  • International shipping available upon request

  • Works are securely packaged and insured where applicable

  • Delivery timeline and tracking will be provided once dispatched

9. ICIP (if applicable)

Where a commission involves Indigenous Cultural and Intellectual Property (ICIP), additional protocols may apply. These will be discussed and agreed upon prior to commencement, including cultural permissions, consultation, and respectful use or display.
